Fumbling Bumbling Idiots Get Massive Pay Raise

By Stephen Simac

The inner workings of the FBI have been revealed in the last months and they're ugly. Like an overripe watermelon splitting open from its rotten core the Federal Bureau of Investigation hasn't looked so bad since the days when cross dressing J. Edgar Hoover was trampling over the Constitution.

The FBI has been called the Fact Burial Industry because they often obliterate instead of investigate critical evidence in the cases they pursue. This reputation has been maintained recently by revelations that leads which could have prevented the 9/11 attacks were derailed, and that top agents were "cavorting with terrorists" for decades in Boston.

Most recently a jury awarded the Earth First! Redwood Summer organizers Darryl Cherney and the estate of deceased Judi Bari $4.4 million dollars because the FBI and Oakland police violated their constitutional rights by falsely charging and arresting the two for a car bombing against them in 1990.

Even with these revelations the Fibbies have been rewarded by congress and the Bush administration with increased funding and more unconstitutional powers to investigate and prosecute American citizens and residents.

Delay, Delay, Delay

It took 12 years from the immediate arrest on false charges of Judi Bari and Darryl Cherney for staging their own car bombing on May 24, 1990 for this case to come to trial. The two filed a civil suit against the agents who falsely charged them a year after their arrest.

All charges were dropped against them two months after their arrest by the Oakland DA because there was no evidence to support a case. They sued the Feds and police for conspiring to frame them for the arrest and denying them their constitutional rights of free speech.

When the trial was finally heard their team of lawyers presented an overwhelming case that evidence had been falsified against them, that exonerating evidence had been suppressed, and Oakland police and FBI agents had failed to investigate strong leads and clues as to the identity of the real bomber.

The Fibbies fought the suit all the way with delaying tactics and appeals. They succeeded in pushing their day of reckoning back until the attention deficit media could barely remember the case which they had featured as EarthFirst! Terrorist Bombers on their front pages in 1990. The success of their lawsuit and millions awarded to them by the jury barely made ripples in the media outside the Bay Area.

The defendants were still in total denial during the trial, even claiming that they still believed the pair were guilty when clearly someone else placed the bomb under the driver's seat in order to kill or maim the activists.

The bomber (probably the same person who had been sending death threats to them prior to and after the bombing, signing them The Lord's Avenger) has never been found. The death threats were followed up by the FBI by questioning environmentalists in northern California, not the pro-logging organizations and individuals most suspect. It was much easier to charge Bari and Cherney in their hospital beds after the bombing than do a real investigation.

Reputation, Schmeputation

The arresting Oakland officer, Sgt. Sitterud had been on the force since 1969 and was very familiar with the FBI's illegal and sinister COINTELPRO operation against the Black Panthers in Oakland. The presiding judge refused to allow the jurors to hear anything about the documented illegal activities of the FBI in that operation. Sitterud testified that he had conducted no investigation of his own because he trusted the FBI's reputation. He hadn't even collected all the evidence from the scene before his department issued an affidavit for arresting the victims. He said he based his opinion that the two bombed themselves because the "experts,", FBI agents on the scene, told him they were radicals, suspected of sabotage in Santa Cruz, and the bomb would have been clearly visible in the back seat.

Even to the inexpert eyes of the jurors this claim was the easiest to discredit. The blast hole was directly under the driver's seat, the damage was mainly to the driver seat and Judi Bari who was driving, while musical instruments in the back seat were undamaged.

Three weeks after the bombing, the chief bomb expert of the FBI told the agents in charge of the investigation that the bomb was under the seat, but they continued to maintain their lie about it being in plain sight.

The bomb was also set to explode with a timer and a motion detector. Even suicide bombers know better than that. Bari was expressly non-violent and had led the EarthFirst! to renounce tree spiking while trying to build bridges between tree huggers and lumber jacks and workers.

Practice Makes Perfect

Officers from the FBI and the Oakland police department had been conducting a Bomb Investigator school a month before the car bombing. Their training included blowing up cars with pipe bombs on Louisiana Pacific Lumber company property.

After the car bombing of the EarthFirst! duo the bomb school instructor, Special Agent Doyle was among the first at the scene of the explosion. He overruled an Oakland police sergeant who initially reported the bomb was under the front seat and falsely claimed that the bomb was behind the drivers seat. He said that bags of nails in the back of the car were identical to the nails strapped to the bomb, when they weren't even the same size or type.

Doyle was quoted as saying "I've been looking at bomb scenes for 20 years... and this bomb was visible to the people who loaded the back seat of this car." With instructors like this it's no wonder their "schooling" resulted in such a shoddy investigation.

The affidavit to arrest the EarthFirst! activists contained these false allegations. The FBI and local police also searched the residence where Cherney and Bari had stayed in the Bay Area and even blew up a "suspicious" package in his van which turned out to be tapes of Cherney's music. His songs aren't that bad.

This case showcased FBI ineptness at the least, but most likely it was a deliberate attempt to derail the movement to prevent the wholesale logging of ancient redwood trees in northern California.

Left Handed Cannibals

The false arrest of the EarthFirst! duo and a massive public relations campaign by Pacific Lumber helped defeat a voter's initiative that fall which would have significantly limited the clearcutting of these millennial forests.

As the suit seemed like it would never come to trial, a variety of sideshows developed. While the true identity of the Lord's Avenger and the real bomber may be as elusive as that of Deep Throat in Watergate, many theories were floated about who it was. No in depth investigation was ever conducted by law enforcement.

The longest investigation, at least in length, was written up in a series of articles in the Anderson Valley Advertiser, (a Mendocino county weekly whose writers decidedly trump the Coastal Post in the "inane rambling" department). The writer claimed the bomber was Judi Bari's ex-husband. The Bari tribe denounced this theory while the vicious diatribes by each side proved that the lefties behind the Redwood Curtain are masters at eating their own. The Julia Butterfly saga being another example of attacking their own, mainly because she's too popular and pretty.

Stop Me Before I Kill Again

A trial in Boston of a decorated FBI agent who protected murdering Irish gangsters because they were his informants revealed the east coast Fibbies were as gangrenous as out west.

FBI agent John Connolly was convicted of federal racketeering charges last month for protecting mass murderers and organized crime bosses "Whitey" Bulger and "The Rifleman" Flemmi. These killers were allowed to get away with murder for decades because they provided information to Connolly about other criminals, usually their competition.

His cut also included regular cash bribery from them along with information and in return they were allowed free reign to steal and kill. Connolly was also convicted of warning the two to flee on the eve of their 1995 indictment. Flemmi was caught when he returned to the area, but Bulger is still on the lam, at large while the FBI continues to "look" for him along with the other Top 10 Most Wanted fugitives.

Promote The Clueless

The thirteen page letter that FBI agent Colleen Rowley sent to the head of the agency, Robert Mueller was big news for a week or two. Perhaps because it was buried too deeply in her complaint for the media to read through it, the most damaging charges were ignored in every news story about it.

She wrote that an FBI bureaucrat reviewed both the Minnesota report about the suspicious activities of Zacarias Moussaoui at a flight school there and the Arizona report about strange behavior of other middle eastern flight school students there. This supervisor not only failed to connect the dots, but actually rewrote the Minnesota report deleting key evidence that French intelligence had connected Moussaui with terrorists in Europe. Because of this deletion, a judge ruled against the Minnesota agents request to search his computer harddrive, which turned out to have crucial information about terrorist plans for hijacking planes.

Instead of being fired or demoted, this Special Agent in Charge was actually promoted. This creates a suspicion that he was being rewarded for allowing the terrorist attacks to go forward. Since the FBI, other intelligence agencies and the military have been given increased powers and funding for failing to stop the attacks, it gives credence to conspiracy theories. The most credible being that US intelligence agencies and the Bush administration had extensive warnings about the planned hijackings and chose to allow them to succeed because of the opportunity to increase their unconstitutional powers and funding.

In fact the proposed Homeland Security Act does not address the fundamental errors and miscommunications by the FBI and the CIA and other intelligence agencies before 9/11, merely papers over them with more billions.

The only way we have a chance of learning the truth about this is if the American public demands an independent, open investigation and hearings from Congress. It remains to be seen whether Americans would rather blindfold themselves with flags made in China than learn the ugly truth about their government entrusted with upholding the constitution.
